There were commercial products that just broke because the user had the
-02 KERNAL ROM in the C64, setting the text color to the background
color whenver the screen was cleared.

The -02 KERNAL was much more widespread the the old NTSC VIC-II.

Thus, your argument is not completely valid, because they just did it.
