AFAIK escom bought everything from commodore liquidators and only 
licensed the commodore name to tulip. Originally I think escom just 
wanted the commodore name and had no real use for the rest of it but 
commodore liquidators wanted to sell everything in one lot. Gateway then 
bought everything from escom liquidators, apart from the commodore 
trademark. Gateway only ever wanted the patents for it's portfolio, but 
again the escom liquidators wanted an easy job and sold it as one lot. 
AFAICT Gateway weren't even aware of the Amiga users when they bought 
the assets. So when people started phoning they somehow realized they 
could unload some old laptop external floppy disk drives as Amiga high 
density drives, because like the Amiga HD drives they ran at half speed 
when using high density disks.

I hadn't noticed (or at least remembered) that Gateway is now owned by Acer.

While the liquidators wanted to sell everything in one go, because the 
people buying it were only interested in part of it the contracts may 
not have explicitly mentioned everything. But you will only get to see 
them if you get sued (which is so unlikely that I'll say it's impossible).

I wasn't including kickstarts as "commodore", I probably should be 
clearer and differentiate between Amiga and non-Amiga. It's possible 
they will get upset about the older stuff now they also sell a commodore 
64, but I can't see it happening. Especially as if it's something rare 
that they don't have unless someone decaps it. They have a court ruling 
that says they have a right to distribute kickstart, AFAIK they don't 
have a court ruling that says they own any rights over any non Amiga 
commodore equipment.
