Fast serial interrogation timing question

Does anyone have any thoughts on why the "can you do fast serial" 
interrogation happens even before ATN falls on the C128/C128D/DCR?

I would have expected it would have happened after the 1000uS wait for 
DATA to go low to indicate a device is on the bus.

I suppose it does not matter, but it seems to break the protocol rule of 
"bring ATN low and see if any devices are on the bus".  If we follow the 
burst mode protocol, CBM should have just blindly sent the commands onto 
the bus, and then wait 1000uS for an acknowledgement that the protocol 
was captured (I know, it would not have worked given the HW available, 
but the protocol philosophy points in that direction)
